Enduring Power of Attorney and Guardianship
Enduring Power of Attorney
Have you ever made an Enduring Power of Attorney or considered what legal consequences might result if you do not have one?
An Enduring Power of Attorney will allow an Attorney to continue to act on your behalf in relation to your financial and business affairs in the event that you lose your mental capacity.
Having an existing and valid Enduring Power of Attorney may save costs in the long run. In the event that you were to lose, or suffer diminished, mental capacity, your family and/or friends may otherwise have to apply to the Public Guardian for permission to look after your financial affairs.
Enduring Guardianship
Have you ever considered where you might need to live or what medical treatment you should receive if you were elderly and in need of help?
An Enduring Guardian appointment is a document that enables you, while you have legal capacity to do so, to appoint a person to look after your personal, health and lifestyle affairs in the event that you lose the capacity to make those decisions for yourself because of illness or disability.
